Constitutional Court: The appointment of the Commander-in-Chief is a legislative act outside the jurisdiction of the administrative judiciary.

Constitutional Court

The Supreme Constitutional Court, on Monday, issued its ruling in constitutional case No. (2/2025), during its session held to consider the request for constitutional interpretation submitted by the Prime Minister of the Libyan Government, Osama Hammad. The request concerned the interpretation of the House of Representatives’ Decision No. 20 of 2015, related to the promotion of an officer and the appointment of a Commander-in-Chief of the Libyan Army.

In its judgment, the court ruled the request for interpretation admissible in form. In substance, the court deemed Decision No. 20 of 2015 a legislative act issued by the House of Representatives, and therefore, it falls outside the scope of review and jurisdiction of the administrative judiciary.

This ruling is considered a final settlement of the legal debate on the nature of the decision and reinforces the jurisdictional boundaries between the authorities, particularly concerning decisions of the legislative branch.
