Tripoli – Musa Al-Koni, Deputy of the Presidential Council, issued a statement. He stated that decrees from the Head of the Presidential Council were problematic. They were issued without a formal meeting. They also lacked collective signatures. This represents a clear overreach of established powers. It is an exclusive exercise of shared competencies. This violates the mandatory mechanism. Al-Koni declared in his late Wednesday to Thursday statement. He said current events are not merely procedural disputes. They represent an exclusive exercise of shared powers. This effectively paralyzes the Council’s operations.

The statement, further clarified the situation. It referred to the Constitutional Declaration and its amendments. It cited the Libyan Political Agreement of December 17, 2015. Outcomes from the Political Dialogue Forum were also mentioned. Presidential Council Resolution No. 15 of 2021 was included. These documents established collective leadership as a mandatory principle. This principle governs the exercise of the Presidential Council’s powers. Issuing decrees without official meetings or collective signatures. This clearly exceeds established authorities. It constitutes an exclusive exercise of shared competencies. This violates the binding mechanism.

Al-Koni highlighted a specific example in his statement. Decree-Law No. 1 of 2026 was issued. This concerns the implementation of the Official Gazette. The decree was dated February 2, 2026. No properly constituted meeting was held regarding it. No approved minutes were drafted as per legal procedures. Therefore, the Head of the Presidential Council’s directive. It represents a fundamental breach of jurisdiction. This makes it subject to judicial legality review.

Al-Koni noted that repeated official communications had occurred. These communications emphasized adherence to the collective mechanism. However, the continued issuance of unilateral decisions persisted. This effectively disrupted the principle of collective leadership. It also created an institutional dispute. This dispute concerns the legitimacy of such decisions. He reiterated that current events are not procedural. They are an exclusive exercise of shared competencies. This is a real paralysis of the Council’s work.

Al-Koni warned about the continuation of this approach. He said it undermines the balance of the political agreement. It pushes the institution toward institutional division. This affects its stability and the legitimacy of its decisions. It places the validity of these decisions under legal and political accountability. Musa Al-Koni concluded the statement. He held politically responsible all those. These individuals insisted on exclusively exercising shared competencies. He called on relevant oversight and judicial bodies. He urged them to exercise their jurisdictions. This is to protect legality and preserve the institutional system. This is crucial during the transitional phase.
