The UN Mission: The conflict over the constitutional judiciary threatens the unity of the Libyan judiciary

Tripoli – The United Nations Support Mission in Libya (UNSMIL) expressed concern. It noted the escalating conflict related to the constitutional judiciary. UNSMIL considered this a threat to the judiciary’s unity, independence, and integrity.

In a statement issued Tuesday, the mission said the judiciary is a fundamental pillar. It is crucial for maintaining the unity of the Libyan state. Any division within the judiciary would have far-reaching consequences. These effects would impact all aspects of life in the country. UNSMIL called on all parties to refrain from actions that could lead to judicial divisions. It also urged them to avoid statements that could be interpreted as provocative. Such statements could escalate tensions.

The mission emphasized the critical importance of self-restraint. This is especially true amidst the current political divisions in the country. A unified and independent judiciary forms the cornerstone of the rule of law. It is also vital for democratic governance.

UNSMIL urged all relevant Libyan judicial and political bodies. It stressed the need to engage in constructive dialogue. This dialogue should resolve the important issue. The resolution must preserve the judiciary’s unity. It must also serve Libya’s supreme national interest. The mission noted its readiness to provide any requested support. This support would help ensure the success of consensus-based Libyan efforts. These efforts aim to protect judicial unity and reinforce the rule of law.
