Benghazi – A total of 115 members of the House of Representatives affirmed a critical point. The Council, as the competent legislative authority, has not issued any valid or enforceable decision. These decisions would pertain to imposing taxes or financial burdens of any kind. This includes taxes on foreign currency. They stressed that any circulating correspondence or communications, regardless of their origin, do not reflect the true will of the Council. Such communications do not acquire legal force or binding status. This applies unless they are issued according to correct legislative procedures. They must also originate from an official session with a full quorum. Furthermore, they must comply with the law and internal regulations.
The members clarified that any circulating correspondence attributed to the Council outside this specified context is not enforceable. It does not entail any legal or constitutional effect. Such correspondence cannot be relied upon to take measures affecting the state’s financial or monetary situation. It also cannot affect the rights of citizens. They emphasized that the authority to approve taxes and financial legislation is an inherent and exclusive competence of the legislative authority.
The signatories declared their full legal and constitutional responsibility disclaimed for any measure. This applies to actions not issued by the Council collectively during an official session that met all legal requirements. They called on those affected by the measures taken by the Central Bank of Libya to resort to the judiciary. They should challenge these measures through all available legal means. This action is crucial to preserve rights. It also aims to uphold the principle of the rule of law.
